1.           Purpose of this Privacy Policy

1.1         Mercury Bay Radiology and Health Trust Limited (we, us, our) is committed to protecting and respecting your Personal Information.  We have a legal obligation to comply with the Privacy Act 2020 and the Health Information Privacy Code 2020.

1.2         This privacy policy (Privacy Policy) applies to all our Patients and its purpose is to inform the Patients (you and your) when we collect Personal Information and what we do with it. 

1.3         “Personal Information” is referring to any and all information that identifies you as an individual or relates to an identifiable individual.

2.           Your consent

2.1         As our Patient, we may collect certain Personal Information and medical history from you so we can provide you with diagnostic radiology imaging (our Services).

2.2         You should note that by commencing or continuing your relationship with us, you are authorising the collection and disclosure of your Personal Information, including health information, by us from and to third parties as detailed in this Privacy Policy.

2.3         If you do not wish us to collect and use your Personal Information, it may mean that we will be unable to provide you with our Services.

3.           Data Collection

3.1         We may collect, store, and use the following types of data about you:

(a)               Personal Information about you, provided by you at the time of registering as a Patient of ours, which includes, but is not limited to, your name, address, email address, and any other such Personal Information that you provide to us through your dealings with us.

(b)               Personal Information that is regarded as health information, which includes, but is not limited to, name of your GP or referring healthcare provider, your National Health Index number, medical history, family medical history, diagnostic images, and other health information such as medical test results, diagnosis, and treatments in order for us to maintain your records.

(c)               If applicable, your health insurance and Accident Compensation Corporation (ACC) details.

4.           Sources of data collection

4.1         We may collect and hold Personal Information about you from the following sources:

(a)               you, by filling out any of our registration forms;

(b)               through interaction with our administrators, such as by telephone or email;

(c)               information provided to us by your referring medical practitioner,

physiotherapists, and midwives;

(d)               if an ACC claim has been lodged and relates to our Services, then information from ACC; and

(e)               provided by third parties authorised by you.

5.           Disclosure of your Personal Information

5.1         Upon request made by you to us, you have a right to access and correct any or all of the Personal Information that we hold for you.  We will disclose any or all of your Personal Information that we hold to you as soon as reasonably practicable.

5.2         In some instances, requests for disclosure of your Personal Information may require a fee.

5.3         We will not disclose Personal Information we hold about you to any third party except as set out in clause 5.4 and 5.5.

5.4         We have a contractual agreement with Hamilton Radiology Limited (Hamilton Radiology) as our third-party service provider.  Hamilton Radiology provides the services of radiologists, the electronic storage of diagnostic images, and provides our radiology information system (Comrad) which is held on Hamilton Radiology’s computer. Hamilton Radiology will need to access and hold Personal Information about you to perform services on our behalf, and under instruction from us. 

5.5         Hamilton Radiology has a privacy policy, which includes abiding by policies and procedures designed to protect your Personal Information. Hamilton Radiology’s privacy policy can be accessed from its website www.hamiltonradiology.co.nz.

5.6         We will use and disclosure your Personal Information for purposes directly related to your treatment.  This may include, but is not limited to:

(a)               the transfer of relevant Personal Information to your nominated GP, physio therapist, or midwife; or

(b)               to another treating health service or hospital; or

(c)               to a specialist for referral.

6.           Use of your Personal Information

6.1         While confidentiality is important to us, we will use and disclose your Personal Information for purposes directly related to your diagnosis and treatment, and in ways you would reasonably expect for your ongoing care, and in accordance with this Privacy Policy.

6.2         We will also process and use the Personal Information we collect for the following purposes:

(a)               to hold your Personal Information on our system and to contact you as necessary;

(b)               to update and maintain our records; and

(c)               for any other purpose that you authorise.

7.           Security

7.1         Your Personal Information is held and stored on paper, by electronic means, or both.  We have safeguards in place and take reasonable steps to ensure that your Personal Information held by us is protected from misuse, interference, loss and unauthorised access, modification, and disclosure. 

7.2         Our radiology information system, Comrad, is housed on Hamilton Radiology’s computer.  For information regarding its safeguards please refer to Hamilton Radiology’s privacy policy at www.hamiltonradiology.co.nz.

7.3         However, protection measures are never completely secure and despite the measures we have implemented, we cannot guarantee the security of your Personal Information.  Any submission of Personal Information is at your own risk.

7.4         Where Personal Information is transferred over the internet or by mail, we will take all reasonable care, but cannot guarantee, that a transmission or transfer by mail is always secure.

8.           How long we keep your Personal Information

8.1         We will keep your Personal Information only where it is necessary to provide you services that meet your needs.

8.2         We may also keep your Personal Information after this period, but only where we are required to meet our legal or regulatory obligations.
